⚠️ GEOGRAPHIC RESTRICTION: Pinnacle Web Studio photography services are available ONLY within the South Metro Minneapolis–Saint Paul service area. See Section 2 for covered areas. Photography is NOT available for out-of-state clients or locations outside our defined service area.
1. Photography Services Overview
Pinnacle Web Studio offers professional photography services as part of select web design packages and as a standalone add-on. Photography is performed by the sole proprietor of Pinnacle Web Studio and is intended to provide authentic, high-quality visual content for Client's website and approved digital uses.
Because Pinnacle is a solo-operated business, photography availability is limited and subject to the owner's schedule. Clients should plan to book photography at least 2–3 weeks in advance of their project's content deadline.
2. Service Area — Photography Only
Photography services are available ONLY within the following geographic area:
- Savage, Minnesota (primary location)
- Prior Lake, Minnesota
- Burnsville, Minnesota
- Apple Valley, Minnesota
- Eagan, Minnesota
- Shakopee, Minnesota
- Eden Prairie, Minnesota
- Lakeville, Minnesota
- Rosemount, Minnesota
- Surrounding South Metro communities within approximately 30 miles of Savage, MN
Photography services are NOT available for:
- Locations outside the defined South Metro service area
- Out-of-state clients or locations — under any circumstances
- Locations more than approximately 30 miles from Savage, Minnesota, unless a written Travel Surcharge agreement is in place (see Section 6)
If a Client is located outside the defined service area, photography services will not be provided and the photography component of any package will be omitted. Package pricing will NOT be automatically reduced for omitted photography unless a separate written agreement is made. Clients are responsible for verifying their location falls within the service area before booking. Pinnacle is not obligated to travel to any location outside the service area regardless of circumstances.
3. Booking & Scheduling
3.1 Booking Process
Photography sessions must be scheduled in advance through direct communication with Pinnacle. A session is not confirmed until Client receives written confirmation from Pinnacle. Verbal agreements do not constitute a confirmed booking.
3.2 Advance Notice
Photography sessions require a minimum of 14 days advance notice. Requests with less than 14 days notice will be accommodated only at Pinnacle's sole discretion and may incur a rush fee.
3.3 Session Deposit
All standalone photography sessions (not bundled in a web package) require a 50% non-refundable deposit to confirm the booking.
3.4 Session Duration
Standard sessions are up to 2 hours at the Client's location within the service area. Additional time will be billed at Pinnacle's current hourly photography rate. Pinnacle reserves the right to end a session early if the environment is unsafe, uncooperative, or hostile.
4. Rescheduling & Cancellation
4.1 Client Rescheduling
Client may reschedule a booked session with at least 72 hours (3 days) written notice at no charge, subject to Pinnacle's availability. Rescheduling with less than 72 hours notice will result in forfeiture of the session deposit.
4.2 Client Cancellation
- Cancellation with 7+ days notice: Deposit is forfeited; no further charge
- Cancellation with 3–6 days notice: Deposit is forfeited; no further charge
- Cancellation with less than 72 hours notice: Deposit is forfeited AND Client owes 25% of the remaining session fee
- No-show (Client not present at agreed location and time): Full session fee is due
4.3 Pinnacle Cancellation
Pinnacle may cancel or reschedule a session due to: illness or personal emergency; severe weather; equipment failure; or other circumstances beyond Pinnacle's reasonable control. In such cases, Pinnacle will provide as much notice as possible and offer to reschedule at no additional charge.
5. Weather Policy
For outdoor sessions, Pinnacle will monitor weather conditions. If conditions are unsafe (heavy rain, lightning, extreme cold below 10°F, etc.), Pinnacle may reschedule. Overcast or cloudy conditions are generally not grounds for cancellation — diffused light often produces excellent results. The decision to proceed or reschedule is at Pinnacle's sole discretion.
6. Travel & Extended Area
For locations within the service area, no travel fee applies.
For locations outside the defined service area but within Minnesota, Pinnacle may agree to travel subject to:
- A Travel Surcharge of $1.00 per mile (round trip) beyond 30 miles from Savage, MN
- A minimum session fee as quoted
- All travel costs are the responsibility of the Client
Pinnacle is under no obligation to accept extended-area assignments and may decline for any reason. Out-of-state photography is not offered under any circumstances.
7. Deliverables & Turnaround
Pinnacle will deliver edited digital photographs via a cloud download link or similar method. Standard turnaround is 7–14 business days after the session. Rush delivery (3–5 business days) may be available for an additional fee.
The number of edited photos delivered will be as specified in the package or agreement. Pinnacle does not deliver unedited RAW files unless specifically agreed upon in writing at an additional cost.
8. Copyright & Image Ownership
8.1 Pinnacle Retains Copyright
All photographs taken by Pinnacle Web Studio are and remain the exclusive copyrighted property of Pinnacle Web Studio. Client receives a limited license to use photographs as described below. Pinnacle retains all rights not expressly granted.
8.2 What Client May Do
Upon receipt of full payment, Client receives a non-exclusive, non-transferable license to use delivered photographs:
- On the specific website built or managed by Pinnacle Web Studio for Client
- On Client's own business social media profiles and posts
- In Client's printed marketing materials for the same business
- In Client's email newsletters and digital advertising
8.3 What Client May NOT Do
Client may NOT:
- Sell, license, or transfer photographs to any third party
- Use photographs on websites or platforms other than Client's own business presence without prior written permission
- Use photographs to represent a different business, product, or entity than the one photographed
- Submit photographs for stock licensing or any royalty-generating use
- Edit or alter photographs in a way that is defamatory, misleading, or damaging to Pinnacle's reputation
- Claim copyright ownership of the photographs
8.4 Portfolio Rights
Pinnacle retains the unconditional right to use any photograph from any engagement in Pinnacle's portfolio, website, social media, and marketing materials. Client may request omission of specific images that reveal sensitive business information, which Pinnacle will consider in good faith.
8.5 Unauthorized Use
Any unauthorized use of Pinnacle's photographs beyond the scope of the granted license will be billed at $500 per image per unauthorized use, plus reasonable legal fees.
9. Subject Consent & Model Releases
If identifiable persons appear in photographs, Client is responsible for obtaining all necessary consent and model releases from those individuals. By booking a photography session, Client warrants that all persons to be photographed have provided consent. Pinnacle is not responsible for claims arising from photographed individuals who have not consented.
10. Client Preparation
To ensure the best results, Client agrees to:
- Prepare the space to be photographed (clean, organized, styled) before Pinnacle arrives
- Have all required props, products, team members, or elements ready at the agreed session time
- Ensure parking and building access for Pinnacle at the agreed location
- Notify Pinnacle of any specific shots or angles required at least 48 hours before the session
Pinnacle is not responsible for poor results caused by unprepared spaces, unavailable subjects, or inadequate notice of specific requirements.
11. Limitation of Liability — Photography
In the unlikely event of equipment failure, file corruption, or other technical failure resulting in loss of session images, Pinnacle's sole obligation is to offer a complimentary re-shoot at a mutually agreed time (subject to availability). Pinnacle is not liable for any indirect damages, lost profits, or business losses resulting from missing or delayed photographs.
